Action for declaratory judgment under sec. 269.56, Stats., commenced June 18, 1954, by plaintiff-respondent, City of Milwaukee,
a municipal corporation, against the defendant-appellant, Sewerage Commission of the City of Milwaukee, a special municipal
district organized pursuant to a special act of the Legislature for the purpose of providing sewerage disposal facilities
to the City of Milwaukee. In its amended complaint the City of Milwaukee seeks declaration that (1) the proceedings undertaken
for the accomplishment of the consolidation of the Town of Lake and the City of Milwaukee were in all respects valid and of
full force and effect, and (2) that the Sewerage Commission is authorized to expend public funds for the purpose of providing
main sewer facilities in an area which prior to the consolidation was embraced in the Town of Lake. The defendant demurred
to the amended complaint on the ground that the same does not state facts sufficient to constitute a cause of action. On September
16, 1954, the trial court entered an order overruling the demurrer, with leave to answer or otherwise plead to the amended
complaint. This appeal is from said order. STEINLE, Justice.
