The Milwaukee Police Association and Marvin Lund seek review of a decision of the court of appeals 1 affirming an order
of the circuit court that vacated an arbitration award ordering that Mr. Lund be transferred from patrolman to an acting detective
status in the Milwaukee Police Department. The basic dispute in this case centers around the authority of the arbitrator to make the award. The opinions of the lower
courts, however, focused on the arbitrability of the grievance itself. As a result, we will also address the question of the
arbitrability of the grievance. We conclude that although the grievance was arbitrable, the arbitrator lacked the authority
to enter the award made. We accordingly affirm the decision of the court of appeals.
